Terms & Conditions
Our Mission:
We exist to provide guests with a welcoming retreat intended for relaxation and recreation. Our comfortably rustic accommodations offer unique access to the surrounding nature, history, local charms, and hospitality that rural life affords. We aim to evoke the nostalgia of simpler times, and offer space where new memories may be forged. We invite all who are inclined to slow down, breathe deep, and rejuvenate with us, here at Buffalo Gap Retreat.
Hygiene protocol:
Buffalo Gap Retreat is committed to providing a safe and secure experience for all. Stricter hygiene measures have been in place since the outbreak of COVID-19, and we continue to review and adjust our standards to be in-line with the latest research and guidelines from state and federal agencies.
To protect the health and safety of our guests, it is Buffalo Gap Retreat’s policy that guests should not check into a listing if any of the following are true:

You are actively infected or have tested positive with COVID-19 in the past 14 days

You suspect you are sick or have been exposed and are awaiting test results to confirm or deny a diagnosis of COVID-19
-
You are showing symptoms or are concerned about possible infection of COVID-19
-
You’ve had close, sustained contact with an individual confirmed or suspected to be infected with COVID-19, within the last 14 days
The rental party agrees to maintain social distance from other guests, practice proper hygiene before and after making use of any common space or amenities, and abide by all posted policies. Further, the rental party assumes all risk and agrees to release Buffalo Gap Retreat, LLC from any and all liability for unintentional exposure or harm due to COVID-19.
Reservation:
Reserving guest must be 18 years of age or older and present a valid photo ID, upon request.
Reservation is guaranteed for the dates confirmed on the invoice provided, are for the booking party and their guests only, and are non-transferable. Any non-cancelled reservation will be considered fulfilled even if the booking party and their guests do not show up for the scheduled dates.
Booking and Payment:
When booking an accommodation at Buffalo Gap Retreat, you are agreeing to pay all charges including the listing price, applicable fees & taxes. You are also agreeing that Buffalo Gap Retreat’s payment provider(s) may charge and collect any monies due. When you receive confirmation for your booking, a contract for your reservation is formed directly between you and Buffalo Gap Retreat, LLC. The cancellation policy and any other rules, standards, policies, or requirements identified in the listing, on the website, or during the booking process, all form part of your contract with Buffalo Gap Retreat, LLC.
Booking party agrees that Buffalo Gap Retreat LLC, may charge them for any unpaid additional services, penalties, or fees attributable to the booking party including any costs associated with returning the property and/or amenities to the state they were in upon the booking party’s check-in. Any such charges will be identified and invoiced within 72 hours after the booking party’s scheduled check-out time.
Accommodation and Access:
An accommodation reservation is a limited license to enter, occupy and use the accommodation. You will be provided with information on how to best access and utilize the rented space within the week in advance of your check-in date.
Buffalo Gap Retreat, LLC retains the right to enter the accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) it is consistent with applicable law.
Linens and Towels:
Linens and towels are not provided as part of the price for accommodations. Be sure to bring sheets, blankets, pillows and/or sleeping bags and towels for swimming and bathing. Extra blankets may be helpful for cool mountain nights. Linens for rental may be available at the Office Cottage, subject to availability.
Amenities and Facilities:
Your reservation includes normal-business-hours access to camp amenities and facilities, subject to availability. Access to certain, for-fee, amenities such as the Sauna or Massage must be arranged beforehand by inquiring in person at the Office Cottage.
Availability and access to camp amenities and facilities may be temporarily restricted due to special events, required maintenance, or other health or safety factors.
Use of all facilities and amenities are at the booking party’s own risk. Booking party agrees to abide by all federal, state, and local laws and regulations. All guests are responsible for following proper use and safety guidelines for any activity, and agree to not put themselves or others at risk through their activities on the property.
Cancellation Policy:
For a cancellation to be recognized, cancellations must be communicated in writing to Buffalo Gap Retreat at the email address: info@buffalogapretreat.com. Booking party is entitled to a refund only if cancellation occurs up until seven (7) days before the scheduled check-in date. Any cancellations made seven (7) days before the scheduled check-in date will be charged a cancellation processing fee of up to six percent (6%) of the total price of the booking invoice. Booking party recognizes that last-minute cancellations introduce financial harm to Buffalo Gap Retreat and that cancellations communicated within seven (7) days of the scheduled check-in date are not eligible for a refund, in part or in full. Any COVID-19 related cancellations communicated up to fourteen (14) days before the scheduled check-in date may have their cancellation processing fee held and applied to a future reservation, subject to scheduling and availability.
Check-In:
You will be provided with directions on how to access your accommodation, and door codes will be provided within 48 hours of your scheduled check-in date, where applicable.
Standard check-in time is 2:00PM on the scheduled day of arrival. You may contact us ahead of time to determine if an earlier check-in time is possible. On your day of arrival, you and your guests are allowed to arrive and enjoy the property ahead of your scheduled check-in time. Please use general parking until your scheduled check-in time.
Upon check-in, the booking party shall immediately notify management of any damages to, breakages in, or issues with, the rented space.
Check-Out:
Standard check-out time is 11AM. The booking party, their guests, and all personal belongings, must be fully vacated from their accommodation(s) by this time to best facilitate cleaning protocols and scheduling. Requests to management for late check-out will be accommodated as circumstances allow.
Please report any damage or maintenance issues with the accommodation before check-out. The booking party is responsible for any damages or breakages found that are over and above normal wear and tear and usage.
As part of the check-out process, the accommodation must be returned to its original state according to the following guidelines:

Return all moved beds, shelves, furniture, and etc, to their original positions.

Wash all dishes and cooking utensils thoroughly, and leave them in the dish drainer.
-
Remove any food traces from cooking devices and surfaces, and throw away any coffee grounds left in the coffee maker.
-
Remove all food and beverage from the refrigerator, freezer, and cabin.
-
Turn off all appliances and set refrigerators and freezers to their lowest settings.
-
Turn off air conditioning, fans, and heaters.
-
Garbage should be removed from the accommodation and placed in trash cans or dumpsters on-site.
Failure to leave the accommodation in a tidy condition may result in additional cleaning fees being levied.
Occupancy:
Occupancy granted by booking with Buffalo Gap Retreat grants the booking party the right to assign guest status to individuals associated with the booking party, numbering up to the maximum occupancy allowed for their accommodation(s). Guest status is non-transferable between different individuals. Maximum occupancy is determined on a per-accommodation basis and may not be exceeded for any reason. Day-use access for visitors of the booking party or their guests cannot be guaranteed and must be discussed and approved beforehand with Buffalo Gap Retreat management.
Access to the property is limited to the dates confirmed at booking. Staying beyond confirmed dates and times is not allowed. Anyone in violation of these policies is subject to removal from the property in a manner consistent with applicable law, and may be subject to overstay penalties.
Traveling with Minors:
All minors must be accompanied by a parent or legal guardian who is legally authorized to act on behalf of the minor, and who is responsible for their supervision. Children under the age of 13 must be accompanied by an adult when accessing the property and amenities.

Pets:
Pets must be registered at the Office Cottage on the same day as check-in or before. A $10 per-pet fee applies. Two well-behaved pets are allowed per accommodation, must be accompanied at all times, and are required to be on leash when outdoors. The booking party and their guests may not bring any animals to the property with aggressive, disruptive, or damaging behaviors, and certify that any animal brought onto the property is fully up to date on their vaccinations.
The booking party and their guests are expected to clean up after their pets and should take dogs to low-traffic areas or the dog park for urination and defecation needs. Pet waste bags may be obtained at the Office Cottage or the dog park.
Only registered service animals may be allowed inside any shared building or structure on the property.
Limited swimming may be allowed for dogs only in non-peak hours, when people are not actively boating or swimming. Owners must use their own discretion to avoid causing issues for guests or wildlife. Management reserves the right to ask for pets to be removed from the property for any reason.
Animals brought to the property are at the booking party's and/or owners’ own risk and liability. Any damage incurred, or cleanup required, will be assessed and charged within 72 hours of check-out.
Roads and Driving:
Passenger vehicle access within the Buffalo Gap Retreat premises is granted to the booking party and their guests for the purpose of getting to and from their accommodation. No excessive driving is allowed, and after-hours driving should be limited to emergencies only. Speed limit is 10 MPH. Speeds should be reduced to 5 MPH when pedestrians or animals are present. Driving or parking on the grass, even temporarily, is prohibited. Roads must remain clear.
The booking party and their guests are responsible for any damage caused by their driving and vehicles on the property, beyond normal wear and tear.
Due to the noise, wear-and-tear, and/or danger presented to other guests, no personal recreational vehicles (ATV’s, off-road vehicles, golf carts, bicycles, wheeled boards, etc.) are allowed to be driven or ridden on-site.
Parking:
Park in designated areas only. Parking is established on a per-accommodation basis and any cars in excess of the per-cabin limit should be communicated to management beforehand. Any cars in excess of the per-cabin limit must be agreed upon beforehand and must make arrangements to utilize the general parking lot near the entrance to the property.
Quiet Hours:
All guests are asked to respect the property and privacy of their neighbors and not to make any excessive noise between the hours of 10PM and 8AM. This applies to activity both inside and outside the cabins. Partying, and/or disruptive behaviors are not tolerated, and all complaints are investigated by management. Guests may be given a single warning before penalties and damages are assessed.
Campfires:
Accommodations at Buffalo Gap Retreat come with access to a stone fire circle and/or charcoal grill. Fires and/or cooking must be contained within designated areas only. Buffalo Gap Retreat reserves the right to restrict any/all fires in dangerous weather conditions.
Guests are encouraged to bring charcoal, and fire tending accessories (firestarters, tinder, matches…). Any outside firewood should be bought locally to avoid distribution of invasive pests. Firewood may be purchased on-site by paying the posted rate at the honor box at the Office Cottage. Please do not pull or cut branches or wood from living trees or shrubs. Please do not pull firewood from any source not obviously labeled for sale.
Nudity:
Buffalo Gap Retreat is a family oriented property that shares space with neighbors, and the local community. Nudity is not permitted in any outside space, at any time. Violation of this rule is subject to removal from the property, without any refund or compensation granted.
Lake Use - Swimming, Fishing, and Boating:

No lifeguard on duty - swim at your own risk.

Children under the age of 14 must be supervised by an adult at the lake at all times.

No swimming or boating after dark is allowed
-
No alcohol or public intoxication allowed.
-
No diving.
-
Fishing is catch and release only.
-
Boats, games, and equipment are provided for the enjoyment of all guests.

Boats and watercraft are only allowed outside of designated swimming areas.
-
Motorized boats or watercraft are not allowed.
-
Please return items (boats, life jackets, oars, balls…) to their original location after use.

Any personal items left unattended along the beach or shore are subject to removal and/or disposal.

Limited swimming may be allowed for dogs only in non-peak hours, when people are not actively boating or swimming. Owners must use their own discretion to avoid causing issues for guests or wildlife.

NUDITY IS NOT ALLOWED IN ANY PUBLIC SPACE, AT ANY TIME.
Consumption of Alcohol:
Guests of at least 21 years of age are permitted to bring their own alcohol and consume it within their cabins or tents. However, carrying or drinking alcoholic beverages from open containers anywhere else on the property is strictly prohibited. Beer and wine are available for purchase on an onsite/take out basis at the Lakeview Cafe at Buffalo Lodge. The booking party and guests agree and warrant that under no conditions shall there be any consumption of alcohol by persons under the age of 21 and specifically acknowledge that they are solely liable for the consumption of any alcohol at Buffalo Gap Retreat facilities during their stay.
Smoking & Vaping:
No smoking or vaping of any type is allowed within any structure, facility, or amenity including such outdoor shared gathering spots as the beach, or shared firepit areas. Tobacco smoking or vaping is allowed outside, but must be done at least 30 feet away from any building entrance, window, or other people. Cigarette butts must be disposed of, and not thrown on the ground, or in fire circles.
Guests who smoke or vape inside may be assessed an additional cleaning charge.
Garbage:
Cabin guests are provided garbage bags and containers in and outside their rental unit. Additional bags are available by request at the Office Cottage. Before departure, guests are asked to remove all garbage and deliver it to the outside containers or the red dumpsters on the hill by the Pavilion Field, or elsewhere, as indicated by Buffalo Gap Retreat management.
Damages:
The booking party is required to provide immediate notification upon check-in of any damages to, breakages in, or issues with, the rented space. Buffalo Gap Retreat can then take necessary action to resolve issues and make sure the equipment and facilities are working and provided as expected.
Property, buildings, facilities, amenities, and all equipment and furniture should be treated with care and kept in order. Items are expected to be returned where they belong after use. The booking party is financially responsible for any damage caused by their, or their guest’s, actions and/or behavior. A summary check will be made of the accommodation upon check-out. However, a more detailed review of the condition of the rented space and all equipment and facilities will be made soon after check-out and before another guest occupies the space. The booking party is responsible for any damages or breakages found that are over and above normal wear and tear and usage. In this case, a statement of damage will be sent by email and/or text message. Buffalo Gap Retreat reserves the right to pursue all legal remedies available to recover damages.
Mobile Phone Coverage and Internet Access:
Buffalo Gap Retreat is a rural destination and as a result, cell phone reception varies at the property and surrounding areas. We cannot guarantee access. Please check with your provider to determine coverage beforehand. We recommend updating offline maps and printing or saving critical information prior to arrival.
WiFi is available at the Buffalo Lodge meeting space. We do our utmost to ensure that internet access is available at all times, but access is not guaranteed, and is subject to the availability of the service provider.
Wildlife:
Buffalo Gap Retreat is located within natural surroundings where encounters with wildlife are possible, and are at the booking party’s and at their guest’s own risk. No hunting is allowed on the property. Fishing is catch-and-release only. Do not approach, touch, pet, feed, or otherwise harass any wild animal. Please report any issues or wildlife encounters to Buffalo Gap Management.
Rental Agreement Termination Events:
Buffalo Gap Retreat LLC reserves the right to terminate the rental agreement, expel the booking party and their guests, levy additional fines or penalties, and/or retain the full booking price, in any of the following circumstances:

Endangering self or others

Illegal activities

Aggressive or threatening behavior

Trespassing or disturbing neighboring properties

Property damage beyond normal wear and tear

Quiet Hours violations
-
Public nudity
-
Public disturbances
-
Pet violations
-
Recreational vehicle use
-
Misrepresentation
Assumption of Liability:
In consideration for the right to enter Buffalo Gap Retreat, the booking party and their guests assume all risk, and liability, and agree to protect, indemnify and hold harmless Buffalo Gap Retreat LLC and its respective heirs, agents, employees and assigns from and against any and all claims, demands, causes of action and damages, including attorney's fees, resulting from any accident, incident, or occurrence arising out of, incidental to, or in any way resulting from, the use of the premises and all improvements thereon. The booking party and their guests agree that they, their heirs, successors and assigns will not make any claim or institute any suit or action at law or in equity against Buffalo Gap Retreat LLC or its respective heirs, agents, representatives, employees, successors or assigns by reason of conditions of the premises or activities occurring thereon.
Personal Data:
By booking with Buffalo Gap Retreat, LLC, the booking party and their guests consent to providing certain personal data which is required to provide the services requested and to improve the quality of service overall. This information may include: contact information, personal details, identity verification, payment and transaction information, or other information such as survey or experiential information solicited about your stay.
Force Majeure:
Buffalo Gap Retreat, LLC shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
Governing Law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of West Virginia. Any legal actions, claims, or demands shall be handled in a court of competent jurisdiction within the State of West Virginia.
